3. Escalation to Management: If the dispute cannot be resolved through initial communication, either party may request to escalate the matter to higher levels of management within our company. Management will review the dispute and facilitate further discussions to find a resolution.

4. Mediation: If informal negotiations and management intervention do not lead to a resolution, both parties may agree to engage in mediation facilitated by a neutral third party mediator. Mediation provides an opportunity for impartial mediation to help the parties reach a mutually acceptable solution.

5. Arbitration: If mediation is unsuccessful or not agreed upon, both parties may opt for binding arbitration to resolve the dispute. Arbitration involves presenting the dispute to an impartial arbitrator or arbitration panel, whose decision will be final and binding on both parties.

6. Legal Action: As a last resort, either party may pursue legal action to resolve the dispute through the judicial system. However, we encourage all parties to exhaust alternative dispute resolution methods before resorting to litigation, as it can be costly and time-consuming.

7. Confidentiality: All communications, discussions, and documents related to the dispute resolution process will be treated as confidential by both parties. Confidentiality ensures that sensitive information shared during the process is protected and not disclosed to third parties.

8. Compliance: Both parties agree to comply with the decisions, agreements, or awards resulting from the dispute resolution process, whether through negotiation, mediation, arbitration, or legal action.

9. Amendment of Policy: G&M Paving and Sealcoat, Inc. reserves the right to amend or update this Dispute Resolution Policy at any time. Any changes to the policy will be communicated to affected parties and posted on our website.

10. Choice of Jurisdiction: In the event that legal action is pursued to resolve a dispute, both parties agree that any legal proceedings, including arbitration or litigation, shall be conducted exclusively in Broward County, Florida. This choice of jurisdiction is agreed upon to provide a convenient and efficient venue for resolving disputes and ensuring consistency in legal proceedings.
